A robbery occurs when theft takes place and some type of force or threat of force was used to obtain money or goods.
Second Degree Robbery
A robbery is charged as second degree when:
- There is no weapon and no injury
- The victim is neither a severely impaired person or an elderly person
Penalties for second degree robbery include jail for 5-30 years and/or fines of up to $10,000.
First Degree Robbery
Your charges could be upgraded from second degree robbery to first degree robbery if:
- A victim or victims were injured during the robbery
- A dangerous weapon was used to commit the robbery
- The victims of the robbery included a senior or someone who was physically impaired
