Sexual Assault & Child Molestation Defense Attorneys
Two of the most commonly prosecuted sex crimes are sexual assault and child molestation. Both sexual assault and child molestation can be categorized based on degree of severity. What degree you are charged with depends on a number of factors including the nature of the assault and the age of the victim.
In Rhode Island, a sexual assault is divided into 1st, 2nd or 3rd degree:
- First degree sexual assault is also known as rape and is a very serious felony carrying the most severe penalties of any sex crime.
- Second degree sexual assault includes situations where the alleged perpetrator engages in sexual contact with someone who is mentally incapacitated or uses force or coercion.
- Third degree sexual assault is also known as statutory rape and occurs when an adult engages in sexual intercourse with someone between 14 and 16 years old.
Child molestation can be categorized into two different degrees, 1st and 2nd. Second degree child molestation includes situations where the accused allegedly touches a child’s intimate body parts without penetration. First degree child molestation is vigorously prosecuted by the State and includes situations where the accused penetrated the anus, vagina or mouth of a child under the age of fourteen.
