How Is Someone Labeled a Habitual Offender?
The Colin B. Foote Act is codified under Rhode Island General Law 31-27-24. It states that a habitual offender may face consequences that include license suspension or revocation for up to one year if he or she has accumulated four moving violations in an 18-month period.
Moving violations may include, but are not limited to the following examples:
- Aggressive driving
- Failing to stop at red lights or stop signs
- Speeding through reduced speed areas
- Overtaking from the right-hand side
- Failing to obey traffic control devices
- Refusing to give right-of-way when indicated
- Using the emergency breakdown lane while traveling
The penalties for violating the Act may include:
- Fine up to $1,000
- 60 hours of driver retraining course, approximately $800
- 60 hours of community service
- License Suspension up to 1 year
- License Revocation up 2 years
