Rhode Island Will Now Allow Expungement of Multiple Misdemeanors

Up To Five Misdemeanor Convictions Can Now Be Expunged In RI

expungement shaking handsEarlier this year, Abilheira Law informed readers that new legislation was proposed in the General Assembly that would allow individuals to expunge up to five (5) misdemeanor convictions.  On July 18, 2017, the Governor signed into law House Bill 5205 Sub. A. This new law still allows first time offenders to expunge one misdemeanor, but also carves out an additional avenue for expunging multiple crimes.

Rhode Island’s Expungement Law Requirements

Under the new Rhode Island expungement law, you are eligible for expungement if:

  • You are a “first time offender,” with no other criminal convictions or probation sentences for misdemeanors or felonies
  • You have not been convicted of a crime of violence
  • You have waited five (5) years since the completion of your misdemeanor sentence or ten (10) years for the completion of your felony sentence

You may also be eligible to expunge multiple misdemeanor convictions if:

  • You have been convicted of more than one (1) but less than six (6) misdemeanors
  • You have not been convicted of a felony
  • You have waited ten (10) years since the completion of your last misdemeanor sentence
  • Note: under this form of expungement, you cannot expunge a domestic violence charge, a DUI charge, or a chemical test refusal

With either avenue of expungement, keep in mind that you must demonstrate good moral character and cannot have any pending charges.

Additionally, under Rhode Island law, you may also be eligible to expunge or seal other charges that were dismissed, resulted in a filing, or resulted in a deferred sentence.
